These terms are an agreement between you and LEGAL_ENTITY ("we", "us"), registered at LEGAL_ADDRESS, covering the Fitting Room browser extension and this website (together, the "Service"). By installing the extension or buying credits you accept them. If you do not accept them, do not install the extension.

1. What the Service is

Fitting Room is a browser extension. You supply a photograph of yourself and select a clothing image from a web page; the Service generates a new image approximating how that clothing might look on you.

Generated images are approximations, not photographs of a real product on a real person. Fit, colour, fabric, drape, proportion and detail may all differ from the actual garment. Do not rely on a generated look as an accurate representation of a product you are considering buying, and do not treat it as advice about sizing or suitability. We are not the seller of any garment shown, are not affiliated with the shops you browse, and have no involvement in any purchase you make from them.

2. No account

The Service has no user accounts. When you install the extension it generates a random identifier that is stored in your browser. That identifier is what your credit balance belongs to. You are responsible for it: if you clear your browser's extension storage from outside the extension, that identifier is lost and the balance attached to it becomes unreachable. See section 6.

3. Credits

• Credits are a prepaid allowance for generating images. They are not money, not a stored value instrument, and cannot be exchanged for cash or transferred between installs.
• Each install receives a small number of free credits. Free credits carry no cash value.
• A standard-resolution look costs one credit; a higher-resolution look costs two. The extension states the cost of a run before it starts.
• If a generation fails, its credit is refunded to your balance automatically.
• Credits do not expire. There is no subscription and nothing renews automatically.
• We may change the price of credit packs at any time. A change never affects credits you have already bought.

4. Payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Paddle collects and remits any applicable sales tax or VAT for your jurisdiction, and the price you are shown at checkout is the price for your country in your currency.

We never see or store your card details. Paddle's own terms and privacy notice apply to the payment itself.

5. Refunds

Refunds are covered by our Refund Policy, which forms part of these terms.

6. Losing your install identifier

Because there is no account, a lost identifier normally means a lost balance. As a courtesy, if you contact us from the email address you used at checkout we will do our best to move your remaining credits to a new install. This depends on being able to match a purchase to you, and we cannot guarantee it — in particular we cannot help with free credits, or with a balance that has no purchase behind it.

7. Acceptable use

You agree not to use the Service to:

• generate images of a person without that person's consent, including any real person who is not you;
• generate sexual imagery, imagery of minors, or content that is harassing, defamatory, hateful or otherwise unlawful;
• impersonate anyone, or create material intended to deceive about a real person's appearance, conduct or endorsement;
• infringe anyone's intellectual property, publicity or privacy rights;
• circumvent, tamper with or automate around the credit system, or attempt to obtain credits you have not paid for;
• resell or commercially redistribute access to the Service.

We may suspend or terminate access, without refund of credits used in breach, where we reasonably believe this section has been broken.

8. Your content and your rights in it

You keep all rights in the photographs you supply and in the images the Service generates for you. We claim no ownership of either, and we do not use them to train models. Your photos, the garment images you select and the resulting looks are stored in your own browser, not on our servers — see the Privacy Policy.

You confirm that you have the right to use any photograph you supply and any clothing image you select, and that doing so does not infringe anyone else's rights.

9. Availability

The Service is provided on an "as is" and "as available" basis. Image generation depends on a third-party provider and on your own network, and we do not warrant that it will be uninterrupted, error-free, or that any particular generated image will meet your expectations. We may change, suspend or discontinue any part of the Service. If we permanently discontinue it, we will refund unused paid credits.

10. Liability

To the fullest extent permitted by law, our total liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, for loss of data stored in your own browser, or for any purchasing decision you make on the basis of a generated image.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all statutory rights available to you in your country of residence, and nothing here overrides them.

11. Changes

We may update these terms. The date at the top says when they last changed. Material changes that affect credits you have already bought will not be applied retroactively.

12. Governing law

These terms are governed by the laws of GOVERNING_LAW, and the courts of GOVERNING_LAW have jurisdiction. If you are a consumer resident elsewhere, you may also bring proceedings in your own country, and mandatory consumer protections of your country of residence still apply.
